The overhauling of LN 136 of 2019, the fulfilment of the Letter of Commitment signed by Government on 2nd August 2019, and the implementation of the Kamra’s A Modern Building & Construction Regulation Framework for Malta have been the Council’s top priority for over two years.
The core objectives behind the Council’s agenda are:
- Ensuring that the regulation of construction processes follows similar regulation in other European Member States and international best practice to promote public safety and quality;
- Ensuring that such regulation does not place periti in positions of conflict, and by inference in an impossible position of trying to compromise between complying with the Code of Conduct and best practice principles, and regulatory processes;
- Ensuring that periti are not compelled by such regulation to carry liabilities that go beyond the liabilities they are expected to carry in international contracts, with the consequence that standard Professional Indemnity Insurance policies are no longer feasible as they do not adequately cover periti, leaving periti exposed to uninsured liabilities, which ultimately undermines the public interest.
Given that the latest amendments to L.N. 136 of 2019 did not adopt the recommendations of the Kamra and those found in the Quintano Report, and in light of the judgement in the Miriam Pace case, the Council felt it was necessary to call an urgent Extraordinary General Meeting for all members of the profession to discuss the principles contained in a directive it shall be issuing shortly.
